Terms and Conditions

Legal Age
In accordance with UK law when you place an order with smithfieldwine.com you warrant that you are at least 18 years of age and that you are legally capable of entering into binding contracts.

Quality Guarantee for Wines
smithfieldwine.com will provide a full refund if any wines turn out to be faulty. All refunds will be provided as soon as possible and at the latest within 30 days of the agreement to refund. We may ask for the items to be returned for inspection. In this case any shipping costs will be borne by smithfieldwine.com.

Claims for Breakages or Shortages
Carriers must be informed of breakages or shortages at the time of delivery or as soon as possible after this time. We must have confirmation of these breakages or shortages within 7 days of the delivery, either by telephone or email.

Minimum Order
There is no minimum order requirement.

Availability
All items are offered subject to availability. Where an item in unavailable an alternative of similar quality and price will be offered.

Vintages
Vintages are subject to change without notice, though due notice will be given where possible.

Prices
Prices are quoted inclusive of UK VAT and duty at current rates and are subject to change without notice.

Payment
Payment is due on order by cheque or accepted credit/debit card as indicated on the web site. Cheques should be made payable to Smithfield Consulting Ltd. and should be drawn on a bank domiciled in the United Kingdom.
Goods will be dispatched when the cheque has cleared.

Cheques Returned
Cheques returned unpaid will be subject to a charge of £10 per presentation.

Overdue Accounts
The vendor reserves the right to charge interest at 2.5% per month or part thereof on overdue accounts, calculated from the due date until the the date full payment has been made.

Reservation of Wines
Wines can only be held on reserve for customers if paid for in full. Paid reserves will only be held free of charge for a period of 4 weeks, beyond this time storage will be charged at the current rate.

Delivery
If a delivery time or date is quoted at any time by the vendor or it's delivery agents, the vendor shall incur no responsibility should such a delivery not take place at the quoted time or date. Time for the delivery shall not be of the essence. We use a courier service to deliver our wines. Delivery is normally made within 7 working days of receipt of order. If we cannot deliver within 30 days of receipt of your order we will inform you immediately and agree another time for delivery. Should we fail to agree, we will offer you a complete refund.

Please ensure the correct address is provided and recipients are able to accept deliveries or give an alternative delivery point such as “leave with neighbour” or “leave in porch. Refused and failed deliveries will be returned back to Smithfield Wine at a cost of £14.50 payable by the buyer. If no-one is available to receive the goods our carrier will notify the recipient of the attempted delivery with a "Card" placed through the letter box. If the items are not claimed within 5 days they will be returned to Smithfield Wine at a cost of £14.50 payable by the buyer.

Title to the Goods
Title to the goods remains with the vendor until such time as all goods supplied by the vendor to the purchaser are paid in full.

Receipt of Orders
Receipt of orders will constitute acceptance of these terms.

Cancellation
You have the right to cancel your order, for any reason, within 7 working days from the day you receive the goods. You will however have to pay the cost of returning the goods to us. We will refund the balance of of your money within 30 days of any cancellation.

Statutory Rights
These terms do not affect your statutory rights if you are purchasing as a consumer.
